Suicide in the US has surged to it's highest level in 30 years and is now the 10th leading cause of death. Opportunities exist for the LNC to participate in the analysis and resolution of suicide claims. Mental Health Professionals (MHP) have a duty to exercise a degree of care and skill that reasonably prudent MHP would exercise in treating mental conditions possibly leading to suicide. Liability is complex in that while there is no affirmative duty to prevent another from self-harm or committing suicide in the absence of a special relationship between the parties, the special relationship between patient and MHP can give rise to such duty.
